Landscape Incident-3/9/2023-Pristine Turf Management and Landscape

On 3/9, Pristine Turf Management and Landscape was hired by South Meade HOA to perform lawn services. During the service, Pristine cut the wires to our landscape lights.

On 3/9, I contacted the HOA and Pristine. The owner was rude and said that he didn't believe that his weed trimmer cut the wire. The owner said he would repair the lights when he could get to it and never provided a timeline.

On 3/10, my husband contacted Pristine. The owner told my husband that the lights were an issue for the HOA.

On 3/13, the HOA President stopped by to give me the HOA covenants. I sent the HOA an email detailing the issue along with a link to the video above.

On 3/16, after exchanging several emails with the HOA including an email where I detailed that Pristine is not a licensed landscape company (nclclb.com) it was agreed that Pristine would come at 4 PM EST to repair the light.

On 3/16, after exchanging several emails with the HOA including an email where I, Timalyn Franklin, detailed that Pristine is not a licensed landscape company (nclclb.com) it was agreed that Pristine would come at 4 PM EST to repair the light.

On 3/16, the HOA Treasurer (Charles Miller) and Lawn Committee (Jerry Wayne Thompson) person came to our property with the Pristine owner (Dwight Collins) to "repair" the lights. When the Lawn Committee Chairman emailed me to come the property, he never mentioned inviting the Treasurer. The visit was scheduled to repair the lights, but as you can see from the video not one of the three people have tools or wires in their hand to repair the lights. It is very clear that their intentions were to bully and harass my husband and me.

Instead of the owner and HOA being apologetic, the Pristine owner was belligerent. Three white men walking onto the property of a black man to intimidate him is intolerable. When my husband requested for all 3 men to leave the property, they continued to argue about the events. Two times (as viewed on the 1st 3/16 video) the owner put his can down to fight my husband. I came out of the house and intervened to calm things down.

Instead of the HOA and Pristine owner attempting to resolve the issue, they escalated and rehashed the issue.

The Treasurer at one point told me I had to have Pristine as my lawn service. After I mentioned Pristine was not licensed, the HOA Treasurer stated that he would only address my concerns if I attended the HOA meeting on 3/18. The HOA meeting is in the HOA Secretaries home. The Treasurer implied that issues could not be emailed and must be submitted in person. (The HOA covenant does not state that issues cannot be addressed by email.)
The Pristine owner continued to call my husband and I liars. However, the Pristine owner damaged our property and refused to be accountable for the damage.
The Treasurer then mentioned that the Architecture Committee did not approve the lights. Our lights have been up for two years. The lights help our non-verbal autistic grandson to not be afraid at night. I responded to the Treasurer that no one else has their lights approved and he could send me a fine. The Treasurer stated that he was going to require everyone to go to the Architecture Committee.
My husband and I went to the rear of the house with the HOA pair. The Treasurer then stated that the wires are not fully buried. The wires are buried along the concrete slab. Once again, the pair were more focused on finding fault with us as HOA paying homeowners rather than addressing the property damage from their non-licensed landscaper.

The bully and racist behavior of the HOA is evident by the fact that they refuse to acknowledge that they hired a non-licensed vendor. Pristine doesn’t have a landscape license with NC and they were spraying chemicals (which we were not notified about) on our yard on 3/9. In addition, Dwight Collins has an extensive criminal background (we have a copy of his criminal record) which is indicative of his character.

On 3/16, we filed police report #23-001085 with Officer Pierce. We were offered the option to file criminal charges for the property damage and have declined at this time. For our safety and given Dwight’s felonious record, the police told us that if Pristine returns to our property that we should call them immediately to have Pristine removed.

The HOA nor Pristine has the right to bully us on our own property.

Landscape Incident-3/31/2023- South Meade HOA Harassment

On 3/21, we filed criminal charges for property damage. We also formally submitted a complain to the North Carolina Landscape Board. In addition, we notified the entire community that the company would not be allowed on our property.

On 3/23, a woman came around our home taking pictures while Pristine was serving other homeowners. We immediately called the police. Three Wilson Police Officers came to assist us.

On 3/31, the landscaper parked in front of our house. The first video shows the landscaper parking in front of our home at 8:38 AM. The second video shows that the landscaper was still in front of our home at noon. The last video shows the landscaper leaving at 2:38PM.

On 4/3 we filed a restraining order against the landscaper. The HOA has retaliated against us with fines for not allowing the landscaper on our property as well as for having landscape lights that are not approved. As of 8/14, we were told that landscape lights were only allowed around the walkway. Above are pictures of other homes who have landscape lights around their home and not just the walkway.

As of 8/10, Pristine was walking onto our property.
